Terms of service
These Terms of Service (“Terms”) govern your access to and use of Arqina (“Arqina”, “we”, “us”), an AI rendering service. By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least the age of majority in your jurisdiction to use Arqina. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Your content and ownership
You retain ownership of the content you upload and of the renders you generate through Arqina. You represent that you have the rights necessary to submit your content and to create the outputs you request.
You grant us a worldwide, non-exclusive license to host, process, and display your content solely to operate and improve the Service, including to improve the AI models and prompts that power it. You can opt out of model improvement at any time by emailing [email protected], as described in our Privacy Policy.
By default, the renders you create are public. This means you grant us a worldwide, non-exclusive, royalty-free license to display, reproduce, and feature them (for example on our website, in marketing and promotional materials, and in public galleries) and that anyone with the link can view them. On plans that include Private mode (currently Pro and Studio), you can set your renders to private, which removes them from public and marketing use. You can change the visibility of new and existing renders at any time from your account, and any new public or marketing use stops once a render is made private.
Usage rights and commercial use
You own the renders you generate, subject to these Terms. Whether you may use them commercially depends on your plan:
- Free plan: renders are licensed to you for personal, educational, and evaluation use only, and not for commercial purposes.
- Paid plans (Starter, Pro, and Studio): while your subscription is active you receive a worldwide, non-exclusive license to use, reproduce, modify, and distribute the renders you generate for commercial purposes, including in client work, marketing, and products or services you sell.
This commercial license is granted only to the extent we are permitted to grant it by the third-party AI providers whose models power the Service, and it does not relieve you of your responsibility to hold all rights to the content you submit and to not infringe the intellectual property or other rights of any third party. Downgrading to the free plan does not revoke commercial rights already granted for renders you generated while on a paid plan; renders you create after downgrading follow your current plan.
Acceptable use
You agree not to use Arqina to:
- Generate imagery you do not have the right to create.
- Generate imagery depicting real persons without their consent.
- Generate sexually explicit imagery, imagery depicting minors, or imagery designed to mislead viewers about real-world events.
- Infringe intellectual property, violate any law, or generate harmful, deceptive, or abusive content.
- Reverse engineer, scrape, or attempt to extract our prompt templates, model weights, source code, or pricing logic, or resell or sublicense the Service.
- Rely on outputs for actual construction, engineering, or permitting purposes without independent review and validation by a licensed professional (see below).
AI output, not professional advice
Arqina produces AI-generated imagery for conceptual and illustrative purposes only. Outputs are not construction documents and are not a substitute for professional architectural, engineering, structural, or design advice. AI output may contain inaccuracies and may not reflect real-world feasibility, building codes, or safety requirements. You are solely responsible for obtaining independent review and validation by a licensed professional before relying on any output for real-world decisions, and Arqina assumes no responsibility for such reliance.
Credits, billing, and refunds
- Subscription credits are granted at the start of each billing period and reset at renewal, they do not roll over.
- Top-up credits you purchase separately never expire.
- Failed renders refund the credits used, automatically, shortly after the failure.
- We do not refund subscription fees for partially used billing periods. You can cancel any time, and your subscription credits remain available through the end of the current period.
- Prices and plans may change; we will give reasonable notice of changes that affect you, and changes take effect at your next renewal.
Third-party services
The Service relies on third-party providers for hosting, data storage, AI inference, payments, and email. Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.
Our intellectual property
Arqina, including its software, design, branding, prompt systems, and underlying technology, is owned by us and protected by law. These Terms grant you a limited, revocable, non-transferable right to use the Service; they do not transfer any of our intellectual property to you.
Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate, reliable, or suitable for your intended use.
Limitation of liability
To the maximum extent permitted by law, Arqina will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, data, or goodwill, including damages arising from downtime, service interruption, or errors or omissions in AI-generated output. Our total aggregate liability for any claim is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Arqina from any claims, damages, and expenses arising out of your content, your use of the Service, your violation of these Terms, or your use of outputs for construction, engineering, or permitting without professional review.
Suspension and termination
We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to Arqina. You may stop using the Service at any time. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, liability, and indemnification) will survive.
Changes to these terms
We may update these Terms from time to time. For material changes we will provide reasonable notice, by email or in the product, before they take effect. Continued use after changes take effect constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict-of-laws rules. You agree that the courts of Cairo, Egypt have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law gives you the right to bring proceedings elsewhere.
General
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Arqina regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
